October 19NEW FORMS: The forms noted below have been revised.  In order to process the actions requested by said forms effectively and efficiently, it is extremely important that proper forms and current versions are submitted: (Click Here for the WCC Forms Page)

1) Request for Action on Filed Issues (WCC H25R) is revised and must now be used to request a change of venue for a WCC hearing.

2) Request to Implead a Party (WCC H33R) REPLACES Request to Implead a Party in an Uninsured Employers' Fund (UEF) Claim.  This form is the only form utilized to implead any party in a WCC claim.  Submission of the form does not initiate a hearing.  An appropriate WCC form, such as Issues (H24R) must be submitted to facilitate a hearing before a WCC Commissioner.  If such request to implead a party is submitted on any other form, no claim-related action will be taken.

Pertinent COMAR 14.09.01.13: Subsequent Injury Fund (SIF) Request for Impleader-
1) - A party who files a request to implead the Subsequent Injury Fund (SIF) within 30 days of a hearing should be prepared to appear at the hearing to present the merits of the prima facie case and/or be prepared to proceed with the hearing unless they are in receipt of a Notice of Continuance from the Commission.  Effective immediately, all parties must utilize the "Request to Implead a Party" WCC Form H-33 (see  NEW FORMS above).

2) Until necessary data infrastructure preparations are completed, when an implead of the SIF is requested on a claim already scheduled for hearing, all parties will receive notice to grant or deny continuance/postponement of the scheduled hearing.  If the request to implead the SIF is denied, said notice will indicate that the continuance/postponement has been denied.  If the request to implead SIF is granted, the notice will indicate that continuance/postponement of the scheduled hearing has been granted.

When a hearing is set on Issues not involving the SIF- the hearing will remain on the docket AND a new Hearing Notice will be generated indicating that the SIF has been impleaded, however the SIF need not appear at the scheduled hearing.
