Procedural Clarification: When the issue of average weekly wage is in dispute after an initial Compensation Deferred Order or an initial Award of Compensation and Average Weekly Wage Order has been entered, a Statement of Wage Information (WCC form C-2) must be filed with the Commission within 60 days after the date of the initial award in accordance with Commission Rule .07.

When
the issue of average weekly wage is in dispute following a hearing before the Commission on the merits, a Request for Rehearing (WCC form H-27R) and Statement of Wage Information (WCC form C-2) must be filed before a Commissioner will amend the Order. Pursuant to LE 9-726, the request must be filed within 15 days after the decision.

If the parties can agree to an amended average weekly wage following a hearing before the Commission on the merits, a Statement of Wage Information (WCC Form C-2) is required to be filed with the Commission within 60 days after the date of the initial award. 
Requests to amend the average weekly wage submitted on a Request for Document Correction (WCC Form C-90R) will not be processed.  Required forms are posted to our Forms and Instructions page.

The Workers' Compensation Commission is in the process of converting pre-printed form templates: Notice of Employee's Claim (C-30), Employer/Insurer Response (C-40), Notice of Hearing (H-51), etc., to an entirely computer printed format. This change will allow us to gain significant efficiencies within our computer operations.  Once implemented we will no longer generate the C-30 and the C-40 on colored paper (blue or pink, respectively).  The conversion of most of these forms should be completed by mid-year calendar 2008. Thereafter, all notices from the Commission will be on white paper.

*Additionally, note the space on the revised C-40 for the Employer/Insurer to provide the name and phone number of the claims service provider/adjuster.
